user agreement

By commissioning me, you have read, agreed and accepted my Terms of Service (TOS). My TOS and prices will change from time to time. Commissions will follow the TOS at the time of acceptance. Please read everything thoroughly 💖

general

• I am providing my digital illustration services as a digital artist only.

• I have the right to decline any commission for any reason..

• I may promote my art commissions on my social media.

• Please credit me (@macaroonillust) if you want to post the commission / my artworks on your social media.

• The softwares I use are:

• Procreate for Flat-colors illustrations

• Clip Studio Paint Pro for rendered illustrations

• You may request for a specific file type or size requirement.

• Flat colors illustrations are around ~1500 px

• Rendered works are around ~2000 px

• Monetized Content fee will be an additional 50% on top of the total price. (This is for streamers, youtubers, etc. using my artworks for monetized projects)

• Commercial (Merchandise) fee will be an additional 100% on top of the total price. (This is for selling my artworks as stickers, keychains, T-Shirts, etc. for profit)

PROHIBITED

• You are not allowed to claim ownership of my works.

• You are not allowed to use my artwork in any AI tool in any way, including (but not limited to):

• Altering my art with AI

• Using my art to train AI models

• Using AI to replicate my style

• You are not allowed to edit, trace, copy, and use the artwork as a base.

• You are not allowed to use my artworks as NFTs

PAYMENT PROCESS

• The payment will be accepted only through Paypal

• My commissions are done in 50 / 50 split payment.

• The payment is an initial 50% nonrefundable deposit upfront before starting work.

• After the rough sketch milestone is completed / approved, the remaining 50% balance must be paid.

REFUNDS & CANCELLATIONS POLICY

Once commission has been agreed and accepted, no refunds will be given on initial deposit.

In the unlikely event that I am unable to complete…

• Rough sketch deliverable — I will refund you the initial deposit

• Final artwork deliverable — I will refund you the balance payment.

TIMELINE & PROCESS

Guaranteed delivery within 1 month after commission confirmation.

• The final product will be delivered within the agreed deadline.

• The deadline may get extended if there is a prolonged waiting time between approval stages.

• If unresponsive within a 5 day period after I send updates for the approval stages, I will proceed with the next stage.

• I will notify you if any delays or unforeseen circumstances were to affect the delivery time.

REVISIONS POLICY

You may request a maximum of 3 major revisions between the rough sketch and rendering stage. Major revisions involve redoing a portion of the drawing.

Some examples (but not all) major revisions include:

• Composition change in rough sketch stage
• Lighting changes in rendering stage
• Changing the entire pose / design of the character

Some examples of minor revisions that are free and acceptable before final product include:

• Slight adjustment of the pose / character
• Colors adjustment

After the commission is confirmed, I will send an invoice for the initial 50% deposit.
4. Initial 50% deposit payment
5. Rough sketch
After the initial 50% deposit payment, I will create a rough sketch and send it to you for approval.Rough sketch includes the character pose guidelines that may have overlapping strokes or messy lines.Lineart is the cleaned-up version of the rough sketch that is ready for coloring.6. Remaining 50% balance payment
After you approve the rough sketch, I will send the invoice for the remaining 50% balance payment.

After providing the remaining payment, I will provide updates for each stage for approval and pause work until it has been approved.

The stages for client’s approval are:
• Rough sketch
• Lineart / cleaned up sketch
• Colors / rendering
• Final

After completing the final product, the full-size .png image(s) and editable artwork files (.csp or .procreate) will be sent.The final product will not include my watermark, but I will include my watermark when posting on my social media.
